Under the new bankruptcy law, in order to liquidate your debts under Chapter 7, you must pass a "means test," demonstrating to the bankruptcy court that you do not have and don't expect to have the means to repay your debts over a period of 3-5 years. The court will examine your last six month's income and consider your prospects for future gainful employment.
If the court determines you lack the means to repay your debts, you will be allowed to discharge many of your debts in exchange for the sale or liquidation of most of your assets. At our offices, we will help you determine whether you will qualify for a Chapter 7 filing. If you do, we will make certain that you understand which debts can be extinguished and that you protect all property that is exempt from sale, such as your home, a vehicle and your retirement assets.
